General Rental Terms and Conditions

This contract is concluded between:

Tobacco : https://villa-harmonie-nimes.com/ - The Client (The Tenant) : The individual making the booking.
Article 1: Object and Destination
This contract concerns the seasonal rental of "Villa Harmonie". The Tenant agrees to occupy the property as a temporary holiday residence and declares on their honor that they maintain a separate primary residence. Subletting is strictly prohibited.
Article 2: Booking and Payment
Refund of 50%. : Prices are indicated in Euros, all taxes included (TTC), including the tourist tax remitted to the city of Nîmes.
Payment Terms : The booking becomes firm and definitive after full payment (100%) of the stay. No down payment or deposit system is used: payment validates the contract.
No Right of Withdrawal : In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services.
Article 3: Security Deposit (Caution)
Usage
In case of refusal or failure to secure the deposit, access to the Villa will be denied without refund.
This deposit covers rental damages and/or additional cleaning fees if the villa is left in an abnormally dirty state.
Article 4: Arrival (Check-in) and Departure (Check-out)
Arrival : From 4:00 PM. The Tenant will receive access instructions (codes or meet-and-greet) after validation of their ID and security deposit.
Departure : No later than 11:00 AM.
'Late check-out' option : A bank imprint (not debited) or security deposit is required before entering the premises.
Failure to respect times : An extended departure until 1:00 PM is possible only if the option was subscribed and paid for at booking (subject to schedule availability).
Article 5: Capacity and Occupancy
The maximum capacity is set at 6 people (including children - whithout babies). Any excess will result in immediate contract termination, eviction of all occupants, and retention of the full payment.
Article 6: Swimming Pool and Safety
The swimming pool is equipped with a safety rolling shutter compliant with current standards.
You must accept the General Rental Terms and Conditions. : The Tenant undertakes to systematically close the rolling shutter after each swim and as soon as they leave the pool area.
Liability : Swimming remains under the sole responsibility of the tenants. The Lessor declines all liability in the event of an accident, particularly regarding minors.
Article 7: Animals
Pets are prohibited.
Exception made for certified service dogs (upon presentation of official documents), which are accepted at no extra cost.
Article 8: House Rules and Nuisances
No Parties Allowed : Parties, gatherings, and events are strictly prohibited.
Neighborhood : The Tenant undertakes to respect the tranquility of the neighborhood, particularly between 10:00 PM and 8:00 AM.
Any unauthorized overstay beyond the scheduled time (11:00 AM or 1:00 PM depending on option) will be charged to cover delay penalties for the cleaning team. : Smoking is strictly prohibited inside the Villa.
Article 9: Liability and Insurance
The Tenant is responsible for all damages caused by them. They are invited to verify they have holiday resort insurance (often included in their home insurance). The Lessor cannot be held responsible for theft or loss of personal belongings.
Article 10: Cancellation Policy
- Cancellation more than 30 days before arrival : 50% refund.
- Cancellation less than 30 days before arrival : 100% of the amount is retained by the Lessor.
- No-Show : 100% of the amount is retained.
Article 11: Personal Data and Applicable Law
Data is processed for booking management. The contract is subject to French law. In case of dispute, the courts within the jurisdiction of the Court of Appeal of Nîmes (FRANCE) shall have sole competence.
